This celebratory Festschrift dedicated to Charles Kahn comprises some 23 articles by friends, former students and colleagues, many of whom first presented their papers at the international "Presocratics and Plato" Symposium in his honor. He spent a year as Visiting Professor at the American School of Classical Studies in Athens, and had additional Visiting Fellowships at Balliol College, Oxford and Clare Hall, Cambridge, and a term as Visiting Professor at Harvard. He is the recipient of several prestigious research grants, from the American Council of Learned Societies, the National Endowment for the Humanities, and the Guggenheim Foundation. In 2000 he was elected Fellow of the National Academy of Arts and Sciences. Three eminent scientists analyze the scientific, social, and political roots of biological determinism.

The situated potentials for action between material things in the world and the interactional processes thereby afforded need to be seen as not only constituting the possibility of agency, but thereby also comprising it. Eo ipso, agency must be de-fused from any local, "contained" subject and be understood as a situational property in which subjects and objects can both participate. Any technological artifact should thus be understood as a complex of agential capacities that function relative to any number of social (...) and material factors. Keeping in mind that we are co-constituted by webs of relations involving increasingly complex collections of artefacts, networks, niches, and communities of practice, our investigation will be guided by interrogating the functional potential of a thing that in the last fifteen years has seamlessly worked its way into the everyday life of millions of human agents. This "thing," the smartphone, is merely a nodal point in a highly complex network. Recognizing this massive "collective," we nevertheless want to show some of the ways in which something as seemingly mundane as a smartphone can reflexively alter the range of actions available to a cognitive agent (Latour 1994). Specifically, we hope to shed light on some of the social-cognitive consequences of technological mediation by looking at the complementary, if not mutually implied, domains of memory and knowledge. Language and tradition have long been relegated to the sidelines as scholars have considered the role of politics, science, technology and economics in the making of the modern world. This reading of over two centuries of philosophy, political theory, anthropology, folklore and history argues that new ways of imagining language and representing supposedly premodern people - the poor, labourers, country folk, non-europeans and women - made political and scientific revolutions possible. The connections between language ideologies, privileged linguistic codes, and political (...) concepts and practices shape the diverse ways we perceive ourselves and others. This 2003 book demonstrates that contemporary efforts to make schemes of social inequality based on race, gender, class and nationality seem compelling and legitimate, rely on deeply-rooted ideas about language and tradition. Showing how critics of modernity unwittingly reproduce these foundational fictions, it suggests strategies for challenging the undemocratic influence of these voices of modernity. (shrink)

Medical migration appears to be an increasing global phenomenon, with complex contributing factors. Although it is acknowledged that such movements are inevitable, given the current globalized economy, the movement of health professionals from their country of training raises questions about equity of access and quality of care. Concerns arise if migration occurs from low- and middle-income countries to high-income countries. The actions of HICs receiving medical practitioners from LMICs are examined through the global justice theories of John Rawls and Immanuel (...) Kant. These theories were initially proposed by Pogge and Tan and, in this work, are extended to the issue of medical migration. Global justice theories propose that instead of looking at health needs and workforce issues within their national boundaries, HICs should be guided by principles of justice relevant to the needs of health systems on a global scale. Issues of individual justice are also considered within the framework of rights and social responsibilities of individual medical practitioners. Local and international policy changes are suggested based on both global justice theories and the ideals of individual justice. (shrink)

This essay argues that marriage is to be defined as an exclusive, indissoluble union of one man and one woman with openness to children. The nature of marriage is approached through an exploration of the nature of love, understood as willing the good of the other. From this study, marriage’s essential characteristics of exclusivity, indissolubility, heterosexuality, and fruitfulness emerge. A brief consideration of the role of the state and its interest in marriage shows that the legal definition of marriage should (...) not deviate from this reality. A general model of problem‐solving processes based on misconception elimination is presented to simulate both impasses and solving processes. The model operates on goal‐related rules and a set of constraint rules in the form of “if (state or goal), do not (Action)” for the explicit constraints in the instructions and the implicit constraints that come from misconceptions of legal moves. When impasses occur, a constraint elimination mechanism is applied. Because successive eliminations of implicit constraints enlarge the problem space and have (...) an effect on planning, the model integrates “plan‐based” and “constraint‐based” approaches to problem‐solving behavior.Simulating individual protocols of Tower of Hanoi situations shows that the model, which has a proper set of constraints, predicts a single move with no alternative on about 61% of the movements and that protocols are quite successfully simulated movement by movement. Finally, it is shown that many features of previous models are embedded in the constraint elimination model. (shrink)

BackgroundHIV prevention research in resource-limited countries is associated with a variety of ethical dilemmas. Key amongst these is the question of what constitutes an appropriate standard of health care (SoC) for participants in HIV prevention trials. This paper describes a community-focused approach to develop a locally-appropriate SoC in the context of a phase III vaginal microbicide trial in Mwanza City, northwest Tanzania.MethodsA mobile community-based sexual and reproductive health service for women working as informal food vendors or in traditional and modern (...) bars, restaurants, hotels and guesthouses has been established in 10 city wards. Wards were divided into geographical clusters and community representatives elected at cluster and ward level. A city-level Community Advisory Committee (CAC) with representatives from each ward has been established. Workshops and community meetings at ward and city-level have explored project-related concerns using tools adapted from participatory learning and action techniques e.g. chapati diagrams, pair-wise ranking. Secondary stakeholders representing local public-sector and non-governmental health and social care providers have formed a trial Stakeholders' Advisory Group (SAG), which includes two CAC representatives.ResultsKey recommendations from participatory community workshops, CAC and SAG meetings conducted in the first year of the trial relate to the quality and range of clinic services provided at study clinics as well as broader standard of care issues. Recommendations have included streamlining clinic services to reduce waiting times, expanding services to include the children and spouses of participants and providing care for common local conditions such as malaria. Participants, community representatives and stakeholders felt there was an ethical obligation to ensure effective access to antiretroviral drugs and to provide supportive community-based care for women identified as HIV positive during the trial. This obligation includes ensuring sustainable, post-trial access to these services. Post-trial access to an effective vaginal microbicide was also felt to be a moral imperative.ConclusionParticipatory methodologies enabled effective partnerships between researchers, participant representatives and community stakeholders to be developed and facilitated local dialogue and consensus on what constitutes a locally-appropriate standard of care in the context of a vaginal microbicide trial in this setting.Trial registrationCurrent Controlled Trials ISRCTN64716212. The Securities and Exchange Commission requires the disclosure of changes to or waivers of corporate codes of ethics. Because the nature of amendments or waivers can vary, we expect the text of Item 5.05 to include different topics within different filings. We examine the population of these disclosures in Item 5.05 8-K filings from 2004 to 2020. While previous studies utilized small samples (fewer than 50 observations) to examine limited aspects of these filings, we use the population of these filings (...) from 2004 to 2020 (2121 8-K filings) to elucidate the nature and details of the disclosures. We assess whether Latent Dirichlet Allocation—a computational linguistics technique—can help discern the underlying topics represented in filings. While the Securities and Exchange Commission identifies two topics—amendments and waivers—the Latent Dirichlet Allocation analysis reveals four topics (three related to amendments): (1) code updates and clarifications; (2) combining codes of conduct for all officers and employees, or splitting codes to include a code directly applicable to senior financial officers; (3) codes of ethics waivers; and (4) substantive code changes. The overall trend is for fewer 8-Ks to be filed in recent years, with updates and clarifications becoming the predominant filing type. Our results further indicate that Item 5.05s related to updates and clarifications, and those related to combined or split codes, use fewer words and are more easily readable than those disclosing waivers or material code changes. Although we find no significant price reaction to Item 5.05 8-K filings, we find significant trading volume and volatility reactions, suggesting that these disclosures could give rise to differences in opinion among investors, which is consistent with the US Senate's assertion that these disclosures are of interest to investors.
